Terms and conditions of sale - umbriaapriori.it
1. General information
Umbriaapriori.it is an e-commerce site for the distribution of wines, oils and other local products, owned by Eat Umbria snc.
The following conditions of sale govern the sale of all products marketed by Eat Umbria snc through the website www.umbriaapriori.it, in compliance with Italian law and EC directives, and in particular with Legislative Decree 70/2003 relating to electronic commerce and Legislative Decree 206/2005 for consumer protection, with specific reference to the legislation on distance contracts. Any changes or new conditions of sale, which Eat Umbria snc reserves the right to make at any time, will be effective from the moment of publication on the website www.umbriaapriori.it and will be applied only to sales concluded after their publication on that website.
The sale of all goods and products on the site www.umbriaapriori.it is reserved only to users who are adults or have reached the age of eighteen at the time of making the purchase.
Registration on the Site is free and is necessary to proceed with the purchase of products.
The acceptance and specific approval of these conditions, which in compliance with current legislation, can be stored and archived by the user is essential for the correct purchase procedure. The user guarantees that the personal information provided is complete and truthful and cannot be transferred for any reason or motive to third parties. The user releases Eat Umbria snc from any obligation to compensate and/or sanction deriving from and/or in any way connected to the violation by the user of the rules on registration on the site. The user agrees to receive, at the email address provided, the communications sent by email necessary for completing the purchase. If the user no longer wishes to receive informative emails from Eat Umbria snc, he/she may request the deactivation of the service by accessing his/her personal area, where registered.
2. Information aimed at concluding the contract
In accordance with Legislative Decree 9 April 2003 n. 70 containing provisions on electronic commerce and current European directives, the user is informed that in order to conclude the purchase contract for one or more products on the site, the user must fill out an order form in electronic format and send it electronically, following the instructions indicated in the purchase section of the site. Correct receipt of the order will be confirmed by Eat Umbria snc by sending a confirmation email to the email address indicated by the user during registration on the site.
The contract is considered concluded when Eat Umbria snc has registered the order received, after checking the correctness of the data relating to the order and payment; the user may, before sending the order, identify and correct any errors in data entry by following the instructions indicated from time to time in the various stages of the purchase; once the order form has been registered and confirmation of the authorization to pay the total amount has been received, the user will receive from Eat Umbria snc via email to the email address indicated, the order confirmation and the relative payment receipt, a summary of the general contract conditions, information relating to the product purchased, the detailed indication of the price, any taxes, the means of payment used, shipping costs and any additional costs, as well as the indication of the Customer Service, which the user may contact to request assistance and/or present complaints and the methods for exercising the right of withdrawal. It is recommended to keep and print the email received as proof of purchase; the order form will be archived by Eat Umbria snc only for the time necessary to process the order and, in any case, within the terms of the law.
3. Product availability and prices
Sales offers are limited by available quantities.
All prices of products for sale on the site are expressed in Euros (€) and include Value Added Tax ("VAT") at the rate current at the time of the order and do not include any taxes, customs duties and other charges applied in the country of destination of the goods, if different from Italy, which remain the responsibility of the Customer, who is also responsible for verifying their existence. Shipping costs and any other additional costs, including VAT, where applicable, and expressed in Euros (€), will be indicated separately in the order form before completing the purchase and will in any case be indicated in the order confirmation email. The price of the products may be changed without notice, it being understood that the price charged to the user will be the one published at the time the order is sent
4. Purchase orders and product availability
The order will be processed by Eat Umbria snc only after receiving confirmation of the authorization to pay the total amount due by the Customer, consisting of the purchase price and any additional costs, as specified in the order form. In the event that the ordered product is no longer available after the purchase order has been sent, the customer will be promptly informed by means of a communication sent to the email address indicated during registration and the purchase order will be cancelled. If the payment has already been made, the total amount paid by the user will be refunded immediately, and in any case within thirty (30) days from the day after the order has been sent, by crediting the same payment method used by the user for the purchase. Any delays in crediting may depend on the banking institution, the type of credit card or the payment solution used and are in no way attributable to Eat Umbria snc.
Eat Umbria snc, in order to preserve the organoleptic characteristics and in consideration of the absence or limited presence of chemical products and preservatives in the products on sale, reserves the right, after specific notification on the Site and during the purchase phase, to limit or suspend shipments in certain periods of the year or to modify the normal shipping and packaging procedure, if the shipment is requested by the Customer even during the possible suspension of shipments ordered by Eat Umbria snc.
5. Delivery of purchased products and verification of the condition of the goods upon delivery
The delivery times for each product will be indicated during the purchase procedure and will, in any case, take place within thirty days from the day following the sending of the order. The delivery of the purchased products can take place exclusively to the postal address specified by the user in the order form, by shipping with a primary express courier with advance payment by Eat Umbria snc and delivery to the floor is not foreseen. The operating methods, the special type of packaging, the shipping rates and the delivery times are indicated in the shipping section of the website www.umbriaapriori.it .
In the event that the package, at the time of delivery by the carrier, shows obvious signs of tampering or alteration, or one of the packages is missing, the user is required to make a reservation on the transport document, indicating that he/she accepts the shipment "with reservation to verify the conditions of the contents" or that he/she "reports the lack of n. packages", while if the shipment is completely or partially seriously damaged, for example with liquid leaks, the user is required to refuse delivery of those packages, indicating the reason in the reservation to be made on the transport document and in any case giving immediate communication to Eat Umbria snc of the incident, indicating the order and shipment references. In such cases Eat Umbria snc will proceed at its own expense to forward a new shipment, making the carrier responsible. The application of the provisions of points 6. (right of withdrawal) and 7. (guarantees) of these General Conditions of Sale remains unchanged.
6. Right of withdrawal
The user has the right to withdraw from the contract, without any penalty and without having to specify the reason, within 14 working days from the date of receipt of the goods.
The right of withdrawal is exercised by sending a communication via email to the Eat Umbria snc Customer Service at info@eatumbria.eu, indicating the number and date of the order, the code of each item for which you intend to exercise the right of withdrawal and your bank details (IBAN).
The goods must be returned intact, in unaltered condition and complete with the original packaging, within 15 days from the date of receipt of the confirmation email from Eat Umbria snc with which authorization is given to return the goods, at the customer's expense, to Eat Umbria snc c/o Logistics srl – Via dei Vetturali 16 – Zona Industriale Santa Maria degli Angeli – 06081 Assisi (Perugia).
Eat Umbria snc will refund the sums paid (excluding shipping costs, pursuant to art. 67, paragraph 3 of the Consumer Code) within a maximum of 30 days from the date on which it became aware of the exercise of the right of withdrawal by the Customer and in any case not before having received the return shipment and verified the condition of the goods subject to withdrawal.
The substantial integrity of the goods to be returned is an essential condition for exercising the right of withdrawal.
The costs and risks associated with returning the products will be borne by the buyer. It should be noted that Community legislation provides that the right of withdrawal can be exercised only by natural persons (consumers) who act for purposes that can be considered unrelated to their commercial activity. The right of withdrawal, therefore, cannot be exercised by legal persons and natural persons who act for purposes related to a commercial activity. Purchases made by retailers or by persons who, for any reason, purchase for resale to third parties are also excluded from the right of withdrawal.
7. Warranties
Eat Umbria snc guarantees the quality of the products it sells or produces and sells and their conformity with the information published on the website and customer satisfaction is our top priority.
In the case of wines defined as “natural” it is important to specify that if still wines present light refermentations, these are to be considered a characteristic of the product given the limited presence or even the total absence of added sulfur dioxide (SO2). It should also be specified that so-called “natural” wines require very low-impact cellar practices and that any reductive notes are to be considered a characteristic of the product. Good oxygenation of the wine will release all or part of the reductive notes.
In the case of extra virgin olive oils, the presence of a sediment at the bottom of the bottle must be considered as a natural effect of decantation that occurs spontaneously in the bottle due to the passage of time. It is not a defect but rather the simple result of natural filtration that has not managed to completely eliminate the solid part of the product.
In the event that the goods prove to be defective, for reasons other than those indicated in point 5 of these conditions of sale, the Customer may then return the goods to Eat Umbria snc c/o Logistics srl – Via dei Vetturali 16 – Zona Industriale Santa Maria degli Angeli – 06081 Assisi (Perugia) within ten days of delivery, with shipping and packaging costs at the Customer’s expense, indicating the reason for the return. Eat Umbria snc will promptly replace the defective goods after verifying the defect found, or refund the amount paid, if the goods are no longer available at the time of return.
8. Place of jurisdiction and applicable law.
The general conditions of contract are subject to Italian law and each sales contract is subject to Italian jurisdiction. For any dispute relating to the general conditions or individual sales contracts, the Court of Perugia will have exclusive jurisdiction, without prejudice to the applicability of mandatory provisions of law in favor of the consumer user.
